Factum of the Plaintiffs (Settlement Approval Motion)

A settlement has been reached in two national class actions concerning class members' claim to certain benefit enhancements that were provided by way of a partial refund of contributions by CMHC to CMHC pension plan members, including plan members, deferred-vested plan memebers and retirees, on or after the 1st January 1999 (the 1st Benefit Enhancement) and on or after the 1st January 2001 (the 2nd Benefit Enhancement).

CMHC has agreed to pay amounts to be distrubed to eligible class members. The settlement is a compromise of the disputed claims and is not an admission of liability or wrongdoing by CMHC.

The settlement has been approved by [or will be submitted for approval to] the Ontario Court. The court has appointed the Bruneau Group Inc. as the Administrator of the settlement. Eligible class members have been notified of the settlement and no further action is required for participation.
